1. Agreement
These Terms of Service ("Terms") govern your access to and use of the NowCook website at nowcook.app and any related services (collectively, the "Service"), provided by NowCook ("we," "us," or "our"). By creating an account, joining the waitlist, or otherwise using the Service, you agree to be bound by these Terms.
2. Eligibility
You must be at least 16 years of age to use the Service. If you are using the Service on behalf of a household or other person, you represent that you have the authority to do so.
3. The Service
NowCook is an AI-assisted meal planning tool that helps users generate recipes and grocery lists based on pantry contents and dietary preferences. The Service is provided for personal, non-commercial use only.
Recipes, ingredient suggestions, and dietary information are produced by automated systems and are provided for informational and convenience purposes only. NowCook is not a medical, nutritional, or dietary advice service. Always consult a qualified professional for any medical, allergy, or dietary concerns.
4. Accounts
You are responsible for keeping your account credentials secure and for any activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
5. Subscriptions, Billing & Cancellation
Paid plans renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Payments are processed by a third-party merchant of record (such as Paddle) who handles invoicing, taxes, and chargebacks.

6. Acceptable Use
You agree not to: (a) reverse engineer, scrape, or attempt to extract source code from the Service; (b) use the Service to generate or distribute unlawful, harmful, infringing, or misleading content; (c) interfere with or disrupt the Service or its underlying infrastructure; (d) use the Service to build a competing product; (e) misrepresent yourself or impersonate another person.
7. Intellectual Property
The Service, including its software, design, content, and trademarks, is owned by NowCook and its licensors and is protected by intellectual property laws. You retain ownership of any data you submit (such as pantry contents). You grant NowCook a non-exclusive, worldwide license to use that data solely to operate and improve the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOWCOOK DOES NOT WARRANT THAT RECIPES OR INGREDIENT SUGGESTIONS ARE SAFE FOR ANY PARTICULAR INDIVIDUAL, ALLERGY PROFILE, OR DIETARY CONDITION.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOWCOOK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold NowCook harmless from any claims arising from your misuse of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for breach of these Terms. You may stop using the Service and cancel your subscription at any time.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or by notice on the Service at least 14 days before taking effect.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
